Legal Question in Business Law in California
Offer of Employment to sole-owner of Business
We are seeking to offer a full time position in our firm to someone who is self-employed in the same field. No stock or asset transfer is involved. She has current contractual obligations to complete that we understand to be minimal. Is there language that can be included in the offer of employment that gives guidelines for completing current obligations while meeting our firms expectations of a full-time employee?

I wouldn't look in forms books for a magic form-ula. Negotiate with the new employee until there is a clear understanding between you as to what she needs and wants to do, and what the company expects and requires in the way of loyalty and time commitments. Then write it up in plain English and incorporate it into your otherwise-standard employment agreement.
