Legal Question in Business Law in California

Online Musicians Contest

2 businesses were running a contest online for musicians to upload their music and the public votes for the best songs. One of the collaborating businesses that was providing the prizes bailed out which left the other company to seek other prizes as an alternative.

The top 3 musicians were notified of this and 3 weeks prior to the end of the contest, each musician was told about the alternate awards. They all knew well in advance there wasnt going to be a cash award as was initially stated prior to the bail out of the other business.

All seemed fine, until the winner was announced and now they want the cash award. Even after being notified and they confirmed knowledge that there was no cash award.

Is the company that didnt bail out, responsible for providing the cash award even though it was clear there wasnt going to be any? This notice was sent out 3 weeks prior to the end of the contest and each musician could have opted to remove themselves from the contest after receiving the prize change notification.

Re: Online Musicians Contest

The answer depends upon what the contest rules and any legal disclaimers said. If there has been a breach, the fact that contestants learned of the breach before the contest ended probably doesn't matter.
