Legal Question in Business Law in California

Partnership dissolution

I cannot afford a lawer and am dissolving a business partnership with someone who has lots of money and a lawyer. There is a "Fair Dealing and Non-Defamation" clause in the legal paperwork. My question is, who decides what is a breech of this paragraph? Someone may falsely accuse me of saying derogatory statements and how would I prove otherwise?

A lot depends on how the paragraph is worded but the short answer to your question is that a jury decides.

Most lawyers will offer a brief initial consultation without charge. You should not decide that you can't afford a lawyer until you discuss your case, and your financial situation, in a free consultation with a couple of attorneys. If you have any assets or property at all, you could lose them by failure to defend in a lawsuit or even as a consequence of being in a partnership and thus responsible for its debts.
