Legal Question in Business Law in California

Payment default for services

I did consulting work for a real Estate

Investment firm and have not been

paid (approx. $7000). I have been

promised payment, even outright lied

to that the check is in the mail, for 6

months. I just found out they are

closing their doors. The owners of

this company also have 2 other

business' in the same office that are

financially better off. They all drive

really nice cars and have really nice

houses. Any suggestions on the best

path to get paid? Not sure what type

of corporation they are. Small

claimsjudgementpersonal lien?

Oh, now you've added more facts. What kind of entity is your written contract with? A "firm" is not a business entity. A corporation? A partnership? A DBA? The individuals?

Hi, Michael. You should a small claim suit in your local county court. The process is simple and inexpensive. Since your case is under $7,500.00, this is the best route to go.

You also won't need an attorney (in fact, you can't be represented by one at such hearings) as it will be a simple "Judge Judy" kind of hearing.
