Legal Question in Business Law in California
A person wrote me a check to pay back a loan that I gave him. I live in San Diego, CA and he lives about 1.5 hours away in Lake Forest, CA. I deposited his check at my bank in San Diego and it bounced. I made a written demand on him pursuant to Civil Code 1719 to pay within 30 days or become liable for treble damages. He did not respond. I have no choice but to sue him at this point. Can I sue him in a San Diego court or do I have to sue him in a Lake Forest court? What is the proper venue? If the check bounced in a San Diego bank, doesn't that make the breach in San Diego and therefore the correct venue in San Diego?
