Right To Use Photographs
Company A sells a steel framed, steel sheeted auto cover material package to home owner. Home owner or third party erects cover. Material package includes fabricated frame by Company A, steel sheeting and components by steel vendor. No patents or rights to design or materials exist. Can Company B in same industry as company A use photograph of cover on it's brochure? Is anyone's permission required?

The photograph may violate Company A's copyright in the image of the cover; and the brochure may be part of an unfair trade practice by Company B. I do not have enough facts to be more definite. If you stand to suffer a business loss, I suggest you consult an attorney and obtain his considered opinion.
