Pretending to be me
If someone is answering their phone and pretending to be my company is that illegal or would it just be a civil case?

It depends upon intent and the nature of the harm done, if any, and could be civil, criminal or both.

To elaborate on what my colleague says, if their intent is to take money from a customer and run off with it, that would be criminal. If they're just joking around, it would be civil. In any case, a lawyer could send a "cease and desist" letter, and that should scare 'em.
