If a successful consumer electronics

product undergoes a change so that

newer models are incompatible with

older models, is a new UPC required?

Can it still be sold under the exact same

name?

Are you asking as the producer of the product or the consumer of the product? If the latter, I'm trying to figure out why/how a new or same UPC would affect you.

It is hard to answer your questions with such limited information but I will give it a shot.

A new UPC may not be needed if the product is priced the same and the description is the same. It really depends on how different the new product is and how the producer, distributor, and/or retailer need to identify the product. The goals of the producer would also be important.

The use of a new name is generally a marketing and trademark issue for the company. Again, I'm struggling with the reason for the question. Do you think you have a claim against the company? Are you marketing a new product and don't know how to proceed?

Again, without more information it is difficult for me to say with any specificity.
