Legal Question in Business Law in California
As is pruchases and recourse of a bad product
I made a purchase of a 52" TV from my employer. This purchase was an "as is" purchase. I took the TV home set it up in my living room, adjusted the set, turned it off, went to bed. The next morning I turned it on and after 30 min the picture was predominately blue and continues to be that way. I paid $915 for this TV and I told the manager and she in turn told the owner and he said he would not refund my money. Do I have any recourse?

No.

Did the man who sold you the TV make any representations that the TV was in good condition? Did he actually make claims that the TV had no problems? Did he state any reason for the "As Is" claim? You might want to sue him in small claims court if he made misrepresentations as to the condition of the TV. Additionally, the judge may find that he charged you too much for a TV he knew did not work properly. It will probably only cost you $50 to file and a day in court, but it is worth a shot.
