Legal Question in Business Law in California
refunded payment..legal ownership?
I own a small internet business dealing in Vintage clothing. I purchased 2 coats from a woman who owns a shop in Chicago. I found her through ebay, but the coats were a direct purchase via exchanged emails. The coats are by a very well know designer and are quite valuable. I recently posted them on my website and one was purchased by a woman who has bought from me before. When she received the coat she emailed me stating she was already the owner of both coats and that I should remove the other from my site until further notice. I contacted the woman I bought the coats from and she told me she had the coats on Ebay last winter and that the woman in question bought them with a buy it now, but her money was promptly refunded because the coats were damaged in a cleaning accident. Apparently the woman was very angry and became abusive so the seller blocked her from any further sales and refuses to do business with her anymore. The woman will purchase the second coat from me only if I tell her the name of the person I bought it from, so she can pursue her lawsuit against her.
I feel horrible doing this. Does this woman have a case against the ebay seller if her money was refunded? Is she the legal owner if they are mine now?

Re: refunded payment..legal ownership?
It is not your concern and you have no legal oblogation to either party. The woman who purchased the coat from you sounds like a nut so I would block her as well. Sell the other coat and be done with it.
Re: refunded payment..legal ownership?
The earlier purchase agreement was breached by the seller, who then made the buyer whole by refunding her money. The buyer never became the owner of the coats, so they are now yours and she has no legitimate claim to them. Even if your seller is lying about the refund, the buyer is entitled only to her money (from the seller, not from you) and not to the coats.
