Legal Question in Business Law in California

Require photo copy of ID card.

Hi

I'm building a online service where it would be best if i would protect users against each other and my company from deceptive indiviudals in some strong evidence way.

And heres my question:

Can i require a photo copy of ID card and/or SS card or Driving license, to be send by fax to my company in order to verify the person?

Re: Require photo copy of ID card.

You'd have to explain your whole concept to me in detail before I'd touch this question! Offhand, I see no value in having someone FAX you identity info - they could be borrowing ID from anyone. The value of photo ID is in being able to compare the photo with the face of the person presenting it.

Use of Social Security numbers and cards for identification purposes is limited by law. Further, there are no photos on Social Security cards.

In looking at the index of the Penal Code, I see about thirty laws relating to identification and ID cards. I didn't study them, nor did I look at any other codes or any Federal laws, but it's clear that ID cards of various kinds are a major concern of lawmakers these days.

Finally, most people are understandably very reluctant to copy their ID and pass it along to a stranger. I'm sure many prospective clients of your proposed business would be turned away by such a demand.
