Legal Question in Business Law in California
I am trying to research the appropriate legal term for what I feel is an unfair and unequitable enforcement of an agreement and it creates an unfair business advantage to others under the same contract where violations are not enforced. Basically, I am being terminated from a Training Association for something we actually did not do, but that others are not even being questioned on who do not have half the reputation or time we do with this major organization. We have been under contract in good standinding for 25 years. Without cause is the letter I got today to terminate my ability to teach classes using their products which is all my business of 25 years does. I have tons of documentation to show over the last 3 years I have been unfairly harrassed by one manager who would like us to go away as she wrongfully provided my business name in response to a State complaint filed and after I spent 2 months proving that she refused to retract it and it affected my reputation and business. I did nothing about it afterwards, but she has been trying to find something else she can pin against me to warrant termination. I have sat on committees for years and watched how this organization handles issues, like with the Mafia getting convicted of Tax evasion...when this organization wants rid of you, they just state "not renewing your agreeement" instead to avoid legal issues. I would be the very last Training Center in my area to be shut down. Although my contract states either party can terminate without cause, this just does not happen hardly ever. You would have to be a really big Cootie for them to take this action...or at least someone would like them to believe this. I have documentation to show how disorganized they are and contradict their own policies. I refuse to just walk away. It has already affected my business revenue by 50% and my health with the constant harrasment of answering to bogus and unwarranted claims or complaints and never one found enforceable. I am spending more of my time defending myself which has caused huge shifts in my ability to conduct business. Without cause for a International Healthcare Training Organization that I have built a business around and frankly my identity can not simply mean they can act without responsibility and integrity.....can it?

You need to meet with someone that handles business contract and business tort disputes. It is not possible to advise you as to your rights without reviewing your contract and discussing all the facts with you. In addition, you do not want advice specific to your situation in a public forum.
A good business attorney will review the contract and discuss with you what happened. He or she will look for claims based on the contract and the course of conduct between you and your organization, and then advise you of your rights and possible courses of action.
