Legal Question in Business Law in California
resignation vs. termination
I am being asked to resign from the hospital where I work... If I do not I will be terminated... If I do resign does that limit my options to take recourse against the institution at a later time? If I resign and state in the letter it is on threat of termination does that allow me an opportunity to take recourse at a later date... I am a nurse and of course do not want a termination on my file but might want to take action in the future...

Re: resignation vs. termination
You should have an attorney. This is not the time to make your primary concern about avoiding attorneys fees. It should be about maximizing your interests. An attorney cannot advise you until they know what possible actions you may have, and have reviewed any written offer to resign you may have received, as well as other documentation. Often, unrepresented parties are pushed around by the employer who is represented by counsel. The sooner you contact an attorney the more options you will have.
IMPORTANT:
No attorney-client nor confidential relationship is created through this communication. You may not rely in any way on this attorney, or any communication from this attorney, and nothing constitutes legal advice nor legal opinion. Your issue may be time sensitive and may result in loss of rights if you do not obtain an attorney immediately.
