Are restaurants retailers under california tax laws?

Restaurants are treated as retailers for purposes of the California sales and use tax laws. They must charge and collect sales tax on prepared food, whether "eat-in" or take out. In this respect they are different from grocery stores (which are retailers) which charge sales tax on most non-food items but not on items which are clearly food for human consumption.
