Legal Question in Business Law in California

Rn benefits

Our hospital gives benefits to 12 hour nurses and consider them full-time if they work 72hr per 2 weeks. But part-time must work 48hr to receive benifits.36hr should be part-time because that is half of 72.The business office employee can work 40hr to receive benefits, which is half time. But 12hr RNs must work more than half time.Isn't that discrimination against12hr RNs?

Re: Rn benefits

If by discrimination you give the term its broadest meaning, I suppose it fits. If you are asking whether it is ILLEGAL discrimination, as would be paying less to nurses who are male, or buddhist, or Aleut, I think the answer is no. There could be some obscure labor code provision I don't know of, but within broad limits and with some well publicized statutory exceptions, employers are fairly much at liberty to set up benefits as they see fit. Maybe it is an effort to induce more nurses to agree to full-time schedules.
