Scrapping Notification of Plastic Injection Molding Tools

What are the California notification requirements to to scrap a customer's obsolete plastic injection molding tool in the supplier's possession? I believe certain verbage is required with a stated time period in which a response must occur. Also, is a specified delivery method provided?

You may be referring to Civil Code section 1140, which looks as though it may apply to your situation. I recommend that you read this section carefully and follow it if it seems to apply to your industry. The Codes are available at most public libraries, at the designated law library in each California county, and on line.

You should also review the contract with the customer to be sure there is no provision covering this situation. In major contracts in the defense industry ownership and possession of tooling is always a major contract issue.

Custom in your industry might also be looked to by a court in deciding whether you had done the right thing or not.
