Legal Question in Business Law in California

Selling a buisness

We created a software program in house to create preliminary liens and now we want to sell it. I want to know if we need to have the program copyrighted before I can sell it?

It depends on more facts but given you were working in house, you need to be very very careful about using technology of your employer even if you created it. The first step is discussing this with an attorney, and you are welcome to call me to do so.

While you already have some common law copyright protection from having written the program, you should also register it with the copyright office (copyright.gov); you should also see an intellectual property attorney about trademarks, license agreements, and possible patents.
