Legal Question in Business Law in California
sending products through mail.
I wanted to know if its legal to mail products to peoples houses and asking them ''if you want you can buy the product which by doing so you are also helping christian families and if not please send it back to us. or keep it to you self at no cahrge'' and this is true, but we are not any organizations and have no permits or any thing. so I wanted to know if Im gonna be needing any permits or such thing to do so. if you can please let me know ASAP. I will really apriciate it.

In addition to what Mr. Starrett has said, I would point out to you that if you imply that part of the proceeds from sales of your merchandise will go to some charitable purpose or organization, and that is not true, this is fraud, and fraud using the mail is a federal offense and punishable by fines and/or prison time.

In addition to what my colleagues' wise words, you should make sure that the product has no potential to do physical harm to the recipients. If it does, I don't think it would be wise to send it without their consent.

It is legal for a charitable organization to mail merchandise in order to solicit contributions. However, the recipient is under no obligation to return or pay for the merchandise. Under federal law, the recipient can legally keep the merchandise or throw it away without paying for it. You cannot rely on them to send it back.
