Legal Question in Business Law in California
Severance pay take back
I have been laid off with a basic severance package. I have been told there is a possibility i will receive my job back. This has happened before at our company, and the re-hired person was asked to give back the severance in full, or have the amount deducted from pay. Is there a limit as to how long i have to be unemployed and then rehired without having to give back my severance pay? I am not eligible to receive unemployment for the time period covered by this severance, and i am afraid to cash it in if i will have to pay it back when i receive my job back.

Re: Severance pay take back
If they hire you back the terms are negotiable and they can request that.
