Legal Question in Business Law in California

My son 20 yrs old entered into a contract to purchase a car for $2500. The contract read only about the deposit reciept ( $ 500 ) and that the car was going to be fixed before purchase.

After the car was fixed the seller is requesting $ 4000 for the car , saying he had communicated this to my son.

My son is looking to get his deposit back, but the seller is declining.

Does he have a case?

Your son's rights will depend largely on what is stated in the contract. Some of the determining factors include whether the contract states the sale price to be $2500 and also whether the contract states that it is the full and entire agreement between the parties. Your son may possibly have a case to enforce the sale of the car for $2500. Of course, in order to better advise you, I would first need to take a look at the contract.
