statue of limitations for collecting old debt in California

person is presented bank checks (as promisory notes) for services rendered with the understanding that when the job is complete the funds will be available to cash the checks but this does not occcur. The party who issued the checks does not honor the checks. the person owed the money attempts to collect but recieves no replay or response from the party owing the money. what is the statue of limitation in California for collecting on a verbal contract in which the person has received bank checks which are not negotiable.

Two years for filing suit on an oral agreement; three years for filing suit alleging misrepresentation (either negligent or intentional).
