Legal Question in Business Law in California
I was told by a plumber over the phone I had a broken sewer pipe and I had sewage which needed to be cleaned up under a house I rent. The plumber gave me the phone number of The Water Damage Experts, I called them and asked them to clean up sewage. They went out and did something, I could not be there. When I arrived at the location I discovered it was a broken water pipe not a sewage pipe. So I do not know what The Water Damage Experts cleaned up but it was not sewage. After battling with my credit card company for months they ended up letting the charges go thru on my card. Now I'm being billed close to $2500.00 plus interest when they didn't even clean up sewage. Can I take them to small claims court? Will I win?

My question to you is whether the landlord should be paying for this repair. Maintenance of damage that isn't tenant-caused is often owner responsibility. Who or what caused this?
