Not unless your contract with them required it.

Well, you can take a person or a company to court for virtually anything; the real question is whether your chances of prevailing are high enough to warrant paying the filing fee and going through the hassle of preparing and serving your complaint. In your situation, the real issues would be (a) whether your contract required them to do this, either expressly or by clear implication; and (b) whether you can prove sufficient damages to make the case worth bringing.
