Why does the UCC distinguish between merchants and non-merchants by holding merchants to a higher standard in some instances?

Because merchants are regularly engaged in the business of buying and selling, and are therefore assumed to have more knowledge and experience then the average person. They should be better able to understand the risks they face -- and better able to protect themselves.
