Legal Question in Business Law in California

''Uniform Rental Contracts''

We are having trouble with the company that rents us our uniforms. We feel that the service is sub-standard. They promise to take care of any complaints with the service, but they go unanswered. Uniforms that need repair are not fixed when promised. Shortages are put off on our company. They never accept responciblity. Can we terminate this contract with a notice of less than thirty days?

Re: ''Uniform Rental Contracts''

You need to be very careful about terminating the contract. The contract may provide that you need to give written notice of any deficiencies and that the uniform supply company then has a right to attempt to cure any alleged defects.

Additionally, you need to be careful about "auto-renewal" provisions that renew the contract for another term of several years unless you give timely written notice of non-renewal prior to expiration of one term.

There may be other terms that will require compliance prior to termination. Therefore, you should have an attorney review the contract BEFORE you attempt to cancel. If you are in a time crunch for auto-renewal an attorney should be able to review it quite quickly.

I would be happy to speak with you about this matter.
