Legal Question in Business Law in California

Unsolicited Goods

Is there a provision in the Law regarding the receipt of unsolicited goods that are sent through the U.S.mails and then Billed for by the sending company? What are the rights or obligations of the receiving party and those of the sending company?

Thank you.

It is simple contract law. The lack of an obligation to pay is based on the fact that you never bought the item or agreed to pay for it.

If you receive something in the mail that you did not purchase, contact the company immediately and ask them why they sent it. You are under no obilgation to keep or pay for something you did not purchase. However, if you keep the item, you may be required to pay for it.
