Legal Question in Business Law in California
URGENT - - Medi-Cal pay back:
My parents are 66 and 65 years of age (Dad 66 & Mom 65) and my mom has been receiving Medi-Cal since April 2012, due to being diagnosed with colon cancer. My parents own their home in Redwood City, CA, it's paid off, and they have 6 children (me being the oldest).
Monday, October 26, the doctor said my mom has approx. 2 months left to live... : ( They do not have a Will or Trust. At the death of the 2nd spouse to die, their wishes are to divide their home into 6 equal shares (gift their home into 6 equal shares.
When the 2nd spouse dies, can Medi-Cal go after their home to pay for the meds and medical treatment my parents' received? (I want to say yes. t I'm not sure if someone told me about this, or if I read it somewhere?)
Please advise. Thanks!!
