There is a trademark issue involved, also. If you have first rights and employ a trademark with your product or service, and you use it online or otherwise, upon registration of the trademark, you may stop an unauthorized distributor from marketing your trademarked product on many theories, including trademark infringement, as well as collect damages, costs, and attorneys fees. The infringer must be using an image of the trademark, and not just a link, for example.
