The VillageCutz is a tailoring company with their head office in Uyo,and branches all
over Nigeria.They have been in the businesses of cloth making for over 20 years. Afrikara is fast rising company that specializes in the selling of fabrics and other clothing materials to tailors.They have been in the businesses for 7 years now and
are gaining attraction. Their head office is also in Uyo. The VillageCutz have been doing business with Afrikara for five years now.They
usually place orders for clothing items and have them delivered.The VillageCutz was contacted By Justice Nsima Akpabio Student Chambers to sew 138 pieces of Maroon Agbada for her Inductees ahead of their Induction on Tuesday 21st May 2024. In order to execute this contract, TheVillageCutZ contracted with Afrikara to supply
them maroon fabrics worth #100,000naira. They emphasized that the colour must be maroon as that was the colour of the chambers they are sewing for. On Friday, The Afrikara Supplied VillageCutz with #100,000 worth of Orange Fabrics,which they used to make Agbadas.The Agbadas were delivered to JNAC on Monday,and they rejected it asking for a refund .The VillageCutz has refunded the money but has now sued Afrikara for Negligence
and breach of contract in supplying Orange fabrics Instead of maroon as requested.The suit was head by the Justice Aniefiok at the Uyo High Court.He ruled in favour of the defendants stating that they were not negligent in the handling of the contractor
guilty for breach of contract.The VillageCutz has instituted an Appeal,at Court of Appeal on the following
grounds:
1.The trial judge erred in law when he ruled that Afrikara was not negligent the performance of the Contract
.2.That the trial court erred in law when he found that actions of Afrikara did not
amount to a breach of Contract
3.That the trial court erred in law when it held that that Afrikara should not indemnify VillageCutz for the losses it made during the contract.
