Web Services Lease

I signed a 3 yr lease that expired in Nov. 06 with a California based company. It states that if written cancellation is not rec'd before end of contract, the lease will automatically renew for another yr. As I missed the deadline, I wanted some advice before writing them. Will the cancellation be effective immediately or will they have rights to continue the entire yr? Auto-payments are made to them thru my bank. Lease is defined by UCC Sec 10103 (7) Supply contract by Sec 10130 (25) and Equip Contract by UCC & 10103 (24). Lessee agrees only CA law will apply. It also says cancellation notice must be written on the back of the original contract. My sig was obtained via fax (with only 1st two pages of the 4 pg contract being faxed) I don't quite remember why we did this except maybe because of additional costs if not completed by certain date and my document would not have been received in time. Any recommendations or information would be much appreciated!

I think you need to have a lawyer read over the lease in order to really get some solid advice as to whether or not you are stuck for another year under the lease. Feel free to contact me if you would like to discuss this further.

The facts you recite don't look good for you, but talk with Mr. Mickelson about the facts and there might be something you can use to get out of the new year.
