Legal Question in Business Law in California

webpage affiliates

If you have affiliates advertising on a personal web page (it is not a buisness web page) do you infact have to have a buisness liscense or be registered as a buisness since the affiliates pay you and some say its considered a e-commerse buisness at that point? Also would it be wise to have a disclamer saying to effect the webpage is not responsible for the affiliates products or services offered by the affiliates?

The need for a business license varies by city, so you need to check your local municipal code to see if you need a business license and what it would cost to get one. Cost usually ranges from $40 to $100 per year.

Whether it would be wise to have a disclaimer is a determination that requires legal advice, and lawyers cannot give legal advice except to clients. In general, a disclaimer is a good idea, but it needs to be specific to the site, and not merely taken from another web site with names changed.

It sounds like a business to me. I'd say you need a license. If your sales (receipts) are small, so should be the cost of the license.
