wedding video contract

It has been almost a year since my wedding and the videographer has still not produced the video. In our interview he said it would only take a few months and in the contract it reads "within four to six months... the completion period is only an approximate length of time and any longer periods necessary for completion will not void this contract".

The one videographer/owner who shot the video who is in possession of the raw footage will not return my numerous phone calls. The second videographer/owner gave excuses such as travel and the fact that he is not in possession of the raw footage. I have made a demand of the raw footage with no response. I want to file a small claims action. Could I receive a judgment for the return of my deposit?? raw footage?? Would I be obligated to pay in full for the raw footage per the contract provision??

It sounds like the videographers have breached the

contract that you had with them to film your wedding. You can sue them for damages if they have lost the film or at least get the film from them and recover your costs. Since they breached

the contract you may not have to pay for the negatives since you will have to pay someone else
