Legal Question in Civil Rights Law in California

Apartment living, law on child running

Hi, My wife and I live on a 2nd floor

condo house with our 2 year old

daughter. The child is playful at her

age and has fun running up & down

the living area - the tiled flooring

seems to accentuate the noise

even more to our neighbor who

lives downstairs. They complained

about 5 times in 5 weeks. Couple of

times he left threatening notes that

he�ll go to Police if the running does

not stop.

We have done all that we can

possibly do to stop her from

running. I once talked to my

neighbor and told him that. When

she is running we take her out to

make her understand that running

is an outdoor activity. Sometimes

she gets that and sometimes not.

Sometimes she runs even more

when we insist her not to do and

she thinks it�s a game.

We are losing peace over this. The

constant threatening notes at our

door-step are worrying. I need help

to understand law on child running

in a community living like condos.

What would the police asks us do,

if they complain?

Sorry to hear about your neighbors insensitivity. Your HOA would govern noise issues; there is no California law on a child running in a condo. If necessary you could ask a Court for a restraining order preventing your neighbor from harassing you but that is an extreme step. If you need further guidance, feel free to contact us.
