Legal Question in Civil Rights Law in California
can I be arrested for not answer a question to an officer? I was outside my apartments (where I live with my foster parents) and it was 10 pm and he came to me and ask my name and birthday and I refused to answer but I did. He wanted to charge me for loitering on private property but its obviously where I live. Can He charge me with loitering ? just for hanging out there at 10 pm and talking with friends?

No he cannot. You should go to his station and file a formal complaint for violating your civil rights.
