Legal Question in Civil Rights Law in California

I just bought a house in California and now find out that a tree on my property is causing foundation damage on my neighbors house. Obviously this has been occuring for some time. Am I liable as the new property owner? This was not disclosed to me prior to purchase

Yes, you are potentially liable because something (a tree) on your property is causing damage to another person's property. Having said that, if the seller or selling broker knew about it and they failed to disclose this to you during the purchase, you can sue them.

Also, please make sure to maintain insurance on your property so if and when you get sued, you ask your insurance carrier for coverage and/or defense.
