Legal Question in Civil Rights Law in California

Me and my boyfriend are renting a room for 440$/month. The guy we rented it from got arressted for warrents but still has a right to live their. The land lord has came and tried to kick us out and move him self in by the end of this month. We already paid our rent & dont know what to do. Were living thier with no water or gas, because the owner & the man we rented from are in a dispute over the house. The guy we rented from was a renter himself. Theyve said he still lives their but the land lord wants to move in. What can we do? But we were told not to let him by the renters family .

I'm sorry that you're in a messy situation. The landlord can't just "kick" you out. He or she must go through legal channels by posting a three-day notice for rent, or 30- or 60-day notice to evict. If you don't move or pay rent in those periods, then the landlord must go to court to file an eviction case against the master tenant, you and your boyfriend. So, it's a lengthy process. Did you pay the rent directly to the landlord or only the master tenant? I've seen cases where folks will pay the master tenant but he or she never passes on the money to the landlord.
