Legal Question in Civil Rights Law in California

We have broken fence at our home in the yard with a few sections totally down. It has been over 18 months since we asked our neighbor, but they keep postponing for one reason or another. We gotten estimates, but they don't want to pay their half saying they can't afford to pay. Neighbor suggested to do it ourself to save money. We agreed and even went out and bought some lumber more then six months ago, but now they don't have time to help put in the fence and buy their share of lumber. As being good neighbor, we have exasted almost all possible ways to go out of our way to cooperate. Neighbor is pretty much counting on us to just get the fence done. What are our legal options? Can we have it done and sue the neighbor for their half? There got to be some type of legal remedy besides us getting the fence done on our dime. Your help in this matter would be greatly appreciated.

Yes, there is a california good neighbor law, which requires that adjoining fence owners must contribute equally to the repairs of a fence. Sue them in small claims court.
