Legal Question in Civil Rights Law in California

Cops came in my house with no warrant

My vehicle was involved in a hit and run accident in which I was not the driver. When I got home I didnt know what had happened but to have the local police department barge in my house and start banging on my bathroom door when I was in the bathroom without clothing. They told me to open the door or they were going to shoot. When I opened the door they had their guns out and there were a couple of the police searching my bedroom. They wouldnt allow me to get dressed until they questioned me. Then after they left they would not give me their badge numbers. There were a total of 5 city police and 1 highway patrol. The highway patrol that was there told me that all badge numbers of the police in my house would be in the police report. I just received the police report and it states only 2 police where in my house. What are my laws & rights. Do I have a case?

Re: Cops came in my house with no warrant

The key question would be who let them in the domicile in the first place. If you allow the police to enter a domicile then anything they can see in the domicile is fair game.

So if someone who had an ownership interest or appeared to have control or an ownership interest allowed the police to enter then things might get a little difficult. You said you were in the bathroom when the police entered. So the police either by breaking down the door or someone letting them in. If the police broke down the door then you have a case. If the police where let in then it has to be determined what was said before they were let in.

You may or may not have a good case depending on some underlying facts. The inaccuracy of the police report is not something that suprises me. However, without more information on the background of the case it is difficult to evaluate.

The information provided to you is of a general nature. You should always obtain competent legal counsel who is familiar with your specific legal issues to determine the best course of action. If we can help you in the future with anything, please feel free to email or contact us at www.unalaw.com
