When the defending attorney requests that teh prosecuting attorney submit evidenc about a client regarding a case and the prosecuting attorney does not submit it is there some sort of penalty involved?

It is a violation of the discovery rules. The remedy is to file a motion with the court compelling production of the evidence, or prohibiting the prosecution from offering it into evidence at the trial.
