Legal Question in Civil Rights Law in California
deprivation of rights
If a state made a law to comply with a federal regulation, and then the agency did not follow the law, is that a violation of a state law or is it a violation of a federal regulation, or is it both?
What court would have jurisdiction in a suit based on deprivation of rights prescribed by this code? Federal or State?

Re: deprivation of rights
It depends on whether or not there is a "private right of action" that would let an individual plaintiff bring a lawsuit. The questions you ask are complicated; the answers depend on the specific facts of the case, as well as the applicable state and federal laws and regulations. If you think you have a lawsuit, call an attorney and make an appointment for an in-person consultation. You might try asking a follow-up question with more facts, we might be able to help you determine what area of law is involved and what type of attorney you need.
