Legal Question in Civil Rights Law in California

Dog Breeder Problems

Hello,

We recently bought 2 puppies from a breeder. We had them for about 6 weeks and they both came down with parvo virus. They were vaccinated by the breeder for this before we got them. We found out that she had vaccinated improperly according to the vaccine manufacturers instructions and have proof of this. She claims she is not responsible for this. After weeks at the vet on IVs, one of them died and the other lived. We spent around $5000 on vet bills. I wrote her a final offer stating we would like the $5000 back and a promise to vaccinate properly and take better care of her puppies and customers in the future and in exchange we would not report the incident as well as her giving us the puppies a week early(against the law) to the press, american kennel club, humane society, or better business bureau. She came back with a huge email, obviously with the assistance of a lawyer, stating that they can get us on extortion. Is this truly extortion? Im only asking for my money back from what we know was her fault in exchange for not reporting facts to the above facilities. I did sound a bit threatening, but i was very upset about the loss of my puppy and tons of expenses due to her

negligence.

Thanks for your help.

Re: Dog Breeder Problems

Sometimes a defense lawyer will threaten one rightly asking for money to get the person to back off, or at least test his/her resolve. Feel free to go to small claims court to get your money for the puppies' purchase and medical bills. Be careful with reporting to others outside government agencies.
