employee or contractor

if paid as 1099 for direct sales am I classified as independant contractor

if so can I set up business and start selling for my own account

To help determine whether or not you are indeed an independent contractor, google for the [20 IRS contractor rules].

Whether or not you are a contractor does not make a difference as far as whether or not you can get away with taking your employer's customers with you when you go (or before you go). Seek specific legal advice in person from an attorney.
