Legal Question in Civil Rights Law in California
My ex-wife has reported to the court false allegations that has resulted in not having me see my children. I have proof she is a compulsive liar in documents and video. Can I file for a civil suit for slander? She is playing the victim role in court, and being woman, the court believes her over myself. My children's education and health are suffering, but court is blind to their decline. My children both have failed one grade, one is obese, the other is malnourished. Regardless of how much their teachers advise their mother to provide extra support at home with reading and familty counseling, my ex-wife refuses to get them help. My daughter is 10, and reads at the level of a 1st grader. I provide their grades and IEP results, the court still favors my ex-wife. What can I do to help them, and protect myself? It seems the only justice I can do is file a slander civil suit so she stops false allegations towards me.

Welcome to the California family courts. And no, you can't sue for slander based on what is said in court or in court papers. If she defames you to others outside of court, go forit.
