Legal Question in Civil Rights Law in California

Hello,

I am afraid to take a person to court over a contract because I am afraid that a judge may throw out the whole contract because my part of the contract depends on payments that I am not guaranteed and if I take this person to court now, there is no indication that I will be paid anytime soon, or ever.

Although I am not guaranteed any payment, can a judge still rule in my favor, just in case I do get paid?

I am just under the impression that if a contract is bases on something that is not guaranteed, then a judge can just throw the whole contract out.

It seems like you are saying that your contract does not guarantee you any payment until a certain thing happens. That does not mean the contract is invalid. You can send a letter requesting re-assurances that upon the contingency happening, that the other party will provide a written guarantee that they will begin to make the payments as anticipated in your contract.
