identify theft

Someone used my name when they were arested and now it shows up on my backgroud, as a result i was fired from my job. the person who did this is my current roommate. i filed a police report and i moved out of the apartment. and the process of moving out this same person and her cousin attacked me. I want to know what next step to take to one get the off my backgroud and two i want to know if it is appropriate to get a restraining order. Both of our names on on the lease, i really want to stay in my apartment but i feel unsafe and she threatens me.

Check on the internet regarding identity theft. The state has an agency -- and perhaps a booklet -- that helps you clear up your record. Of course, you must contact each of your creditors and provide a copy of your credit report. Dispute each charge with the three credit reporting companies -- Experian, TransUnion, and Equifax. Also notify Social Security Administration.

As for the apartment, if she has threatened you and you fear physical harm, you should not be in that living situation. Of course, let the landlord know why you have to leave, at least temporarily. No doubt, she won't have the rent money and will be evicted shortly. Maybe you and the landlord could work something out once she's out of there. Good luck to you.
