Legal Question in Civil Rights Law in California

Judgment submitted by unifund ccr partners rejected on 06/26/2009.

Hi,

If an attorney for a credit card debt went after me for a summary judgement and JUDGMENT SUBMITTED BY UNIFUND CCR PARTNERS REJECTED ON 06/26/2009. this statement came up on the court docs what is the next step for the attorney do I have anything to worry about? If the statue of limitations was a month after the attorney filed suit can the attorney continue to file against me?

Your question suggests that 1) the judgment was a default judgment because you failed to answer, not a "summary judgment"; and 2) the fact that they filed one month before the statute expired (if in fact that is the case) makes their lawsuit valid.

The clerk probably rejected their judgment because they hole-punched it incorrectly, or for one of the many other picayune reasons that court clerks use to reject documents.

To elaborate on what Mr. Stone has written, all the attorney for the creditor might have to do is resubmit the proposed judgment to the court -- perhaps worded a bit differently -- to obtain a judgment against you because the summary judgment probably already has been granted.
