order of examination

I was givin a order of examination 2 months ago. after a Judgement in 1997, I went there and me and the other party agreed to have to oex dropped and dismissed. now I find out they want me to go back to court for a oex.... Am I protected from going or answering there questions with res judicata or some other protection??

If the court has a record of you showing up for the examination, the judgement creditor doesn't get to do another one for, I think, six months, and you could demand monetary sanctions if you know how to file a motion. You could even try not showing up and being arrested and then you could sue for false arrest, obviously this tactic is not for the timid. Be sure and look up the Code of Civil Procedure at www.leginfo.ca.gov .
