Legal Question in Civil Rights Law in California
Hi, recently my boyfriend & I traded My 2005 yz 85 dirt-bike for a 2004 Honda cr 85 expert off of Craigslist. Also included in the trade, my boyfriends "old buddy" who I guess owed my boyfriend some money from the past, threw another little dirt-bike into the deal so that him and my boyfriend would be even again.
Well the next thing I know the cops are at my door saying that the little dirt-bike his buddy traded was a stolen dirt-bike & that the deal was fraudulent that we have to give the bike back to the person who we traded to.
So of course realizing thats not fair, I was more than cooperative with the officer because he said I was gonna get my dirt-bike back from the people we traded it to.
Well after they showed up at my house without my dirt-bike the cop then told me that they didn't want to give my bike back because they had already went out & bought another dirt-bike & now they want $750.00 for it. So now I ended up with no dirt-bike at all.
I just think thats really unfair because I wasn't trying to rip anyone off & I feel like I got ripped off. Is there anything I can do to get my dirt-bike back?

I do not fully understand your question. if the people you sold the bike to bought another bike why would they no twant to give you back your bke? In any case, the law would require allparties to be returned to the position they were in before the enchange. They get theri bke back, you get yor blike back, and your boy friend's friend gets othing as that bike goes back to the rightful owner. The people who exchanged bikes with you have no right to keep your bike. As you wee unaware that the other bike was stolen, and assuming there was nothing that should have made you aware, you are not at fault for the stolen bike.
