Restitution civil litigation, will I ever see any money?

I was granted $42,000 in restitution from adrunk drunk driver who nearly killed me and my boyfriend. My boyfriend was granted $18,000. We were told to take it to civil litigation because this guy is in prison for 5 more years and he is an illegal immigrant. He has no money or property and you can't squeze blood from a trunip ya know. What can we do to make sure we get at least part iof this money, it is to cover medical bills and lost wages and that sort o thing. We were told we can sell it to a collections agency, how do we go about doing this? Any advice is appreciated..we just found out yesterday how much his restitution would be.....

If I understand you, you and your boyfriend were awarded restitution in connection with the criminal case and you are now wondering whether you can bring a civil action, and if so, whether there is any money in it? That depends on whether anyone had auto insurance. Also, when was the accident? There will be a statute of limitations that may require you to file ASAP.
