Legal Question in Civil Rights Law in California
Been served but have no idea what's going on?!?!?!
I have no idea what's going on, Just been served with papers saying I was involved with a motor vehicle accident. I don't recall it, and they didnt give me much information about the case. I was wondering if anyone can tell me how to go about this, like where can I go/ who can I call to get a better understanding on what being thrown at me. Is it wise to contact the plantiff's attorney to try to ask for the details, because I don't know the whole story...Can there possibly be a mixed up? Maybe they served the wrong person? I sold a car to my friend, whom gave it to his sister to have. I'm not sure when they finally turned the pink slip into the DMV, and they dont remember. How is it possible if that was the car that was involved in the accident that they still pull up my name for the case??? Please SOMEONE, HELP. I'm in desperate need of some legal advices...

If you had insurance, turn it over to them.
You need to make sure you file an response with the Court prior to 30 days from service or they can get a juydgment against you.

First, relax. You've got 30 days from the date you're served to come up with some sort of response in court. That will give you a little time to figure out what the mix-up might be.
If you truly don't know where they're coming from with this, you can have an attorney call the plaintiff's lawyer and verify that they've got the right person. In fact, I'm not far from you and would be happy to sit down and look over these things with you at no charge.

Call your auto insurance carrier right away, and send them a copy of the court papers. End of problem. Or, if you didn't have auto insurance, call a lawyer. In any event, do not talk to the plaintiff's lawyer.
